Background to the Case

Presenting the brief facts of the case, the Prosecutor, Chief Superintendent Tuaruka Duuti informed the court that the Complainant (her name withheld by GhanaJustice) lives at Legon whilst the Accused, Lawrence Atipoe Selorm is a student of University of Professional Studies, Accra.

The Police Officer said that on the 25th of April, 2016, at about 5:15am, the Accused attacked the Complainant at a spot near the University Stadium close to Noguchi junction, Legon. He continued that the Accused, who was wearing a black-hood jacket with a cap, dragged the Complainant from behind into a nearby bush and ordered her to lie on the ground and remove her panties, adding that the Accused who pointed a knife at the Complainant threatened to kill her if she shouted. Chief Superintendent also stated that the Accused tried to insert his penis into the Complainant’s vagina but penetration failed, adding that the Accused then ordered the Complainant to put his penis into her mouth which she did and made her suck his penis until he ejaculated into her mouth.

The Prosecutor further indicated that the Accused thereafter collected the Complainant’s bag, searched through it and took her Blu mobile phone valued at GH 750.00 cedis and cash in the sum of GH 100.00 cedis and bolted. He reiterated that on the same day, the Accused started sending WhatsApp messages to the Complainant’s contact requesting for money. The Accused gave a Tigo Cash account number 0273 133 788 belonging to his friend, one Mccarthy Tetteh who is a witness in this case for the money to be sent through to him.

The Accused who pretended to be the Complainant sent text messages like: “I was attacked send me money.” During investigation, the Police tracked the Tigo number and arrested Mccarthy Tetteh and subsequently arrested the Accused who had in his possession the Complainant’s mobile phone. The Accused led the Police to room number 2021 at Elizabeth Sey Hall, Legon campus where the black jacket which he was wearing when he attacked the Complainant was found in his bag.
