Private citizen files for injunction on appointment of new EC

A private citizen, Fafali Nyonator has filed an application for an order of interlocutory injunction to restrain the President from appointing a new Electoral Commission.

The application has been filed, following an earlier suit by the same plaintiff/applicant seeking a declaration that the determination of a prima facie case by the Chief Justice, pursuant to article 146 of the Constitution, for the removal of Mrs. Charlotte Osei as chairperson of the Electoral Commission (EC), was unconstitutional.

According to the Plaintiff/Applicant, the overriding purpose of filing for the injunction is to assist in efforts to entrench the Rule of Law and to seek legal remedies for what she has referred to as patent violations of the Constitution.

It is the case of Fafali Nyonator that, in the event that her claim in this action is upheld, the position of Chairperson of the (EC) can not be said to be vacant to require the appointment of a new Chairperson.

The Plaintiff/Applicant in her affidavits has asked the court that Mrs. Charlotte Osei remain the Chairperson of the EC until she is removed from her position in a manner that is consistent with the Constitution.

Earlier this month, the President, His Excellency Nana Addo Dankwa Akufo- Addo removed Mrs. Charlotte Osei from the position of the Chairperson of the EC, following recommendations of the Committee set up to investigation allegations made against the former EC Chairperson.
