Madam Evelyn Keelson, Chief State Attorney, said that Attorney General’s Department would like to withdraw the charges against six out of the twenty two Accused persons who are currently before court for allegedly murdering Major Maxwell Mahama.
According to the Chief State Attorney, investigation has shown evidence against the six Accused persons namely: Yaw Annor, Philip Badu, Kwame Agyei, Solomon Sackey, Anthony Amoah and Vivian Asahene, the only female amongst the Accused persons.
The presiding judge His Worship Worlanyo Kotoku said that the Bill of Indictment had not been filed and the parties involved had not been served, hence, due process had to be followed.
Madam Evelyn Keelson however argued that the Bill of Indictment was filed the previous day and expressed her inability to understand why it was not in the docket.
She further stated that the law makes provision for the withdrawal of charges against Accused persons, before committal.
The judge allowed for the Chief State Attorney to make an oral application.
The case was adjourned to 19th December, 2017, to allow the Chief State Attorney to serve the parties involved, with the Bill of Indictment, to ensure that the Bill of Indictment is on the docket and also for the Chief State Attorney to formally make the application for the withdrawal of charges.
