ASP Agnes Boafo, the Prosecutor in charge of the fraud case involving a parcel of land against ace musician, Akosua Agyepong and one Frank Agyemang Badu, has been blamed by the Counsel for the Accused persons, B. T. Agbeli, for refusing to provide him with all the documents the Prosecutor intends to rely on during the trial.
Counsel for the Accused persons stated that the actions of the Prosecutor was contemptuous since it was against the orders of the Court.
ASP Agnes Boafo in defence, stated that she had provided the lawyer with all the necessary documents except the indenture because she had been given the original copy the previous day. She expressed her willingness to make a copy of the indenture available to the defence counsel.
Her Honour Priscilla Dapaah-Mireku asked the Prosecutor for the documents she intended to rely on. The Prosecutor stated that she was going to rely on the caution statements by the Accused persons, receipts the Accused persons issued to the Complainant, chat conversations between the Second Accused (Akosua Agyepong) and the Complainant, site plan, and statement of the Complainant.
Counsel for the Accused persons prayed the Court to order the Prosecutor to provide him with documents given to the Complainant by the witness which were in support of their claims.
The judge ordered the Prosecutor to provide the defence counsel with all the documents she said she was going to rely on including documents given to the Complainant by witnesses.
The case has been adjourned to 5th December, 2017.
