An Accra Circuit Court, presided over by His Honour Aboagye Tandoh has sentenced a 39-year old house help, Ebenezer Tawiah to 13 years imprisonment with hard labour for defiling an 11-year old boy and a 13- year old boy.
The Accused was convicted on his own plea to both counts of defilement.
According to the Prosecutor, ASP A. Boadi, the 1st Complainant is a retired Commissioner of Police and the 2nd Complainant is an Administrator at Mother Love Hospital, Adenta-Frafraha, and a son to the 1st Complainant.
ASP Boadi explained that the 1st victim is an 11-year old class five pupil residing with his mother and other siblings opposite the 1st Complainant’s house whilst the 2nd victim is a 14 year old JHS 2 student, the grandson of the first complainant and a friend to the 1st victim.
According to the Prosecutor, the Accused person is the house help of the 1st Complainant and lived at Adenta-Frafraha, a suburb of Accra.
ASP Boadi narrated that the 1st victim was going to the house of the 1st Complainant often to play with the 2nd victim and sometimes watch television with him.
He explained that on one occasion, the 1st victim was alone watching television when the Accused person lured him into a bathroom at the boys’ quarters, smeared a cream on his penis and forcibly had sexual intercourse with him thought the anus.
According to the Prosecutor, after the act the Accused warned and threatened to beat the 1st victim if he informed anyone.
“Accused not satisfied with his lustful desire, repeated the act on the fourth consecutive time at the same premises”, the Prosecutor said.
ASP Boadi stated that on the 28th of September, 2017 at about 8:00am, the Accused was asked by the 1st Complainant to go with his driver to 1st Complainant’s wife’s uncompleted building at Dome Pillar 2, a suburb of Accra to tidy up the place.
He further stated the Accused took the 1st victim with him with the intent of continuing his evil act. Upon arrival, whilst cleaning the place, the Accused had unnaturally carnal knowledge of the 1st victim for the fifth time on the floor of one of the unlocked rooms.
“The victim who could not endure the pain screamed to the hearing of the driver, who rushed to the scene”, ASP Boadi said.
The driver reportedly informed the 1st Complainant when they got home. On the 8th of November, 2017, the 1st Complainant together with the 1st victim arrested and took the Accused to the Police.
ASP Boadi said on 9th November, 2017when investigations were still on going, the 2nd victim narrated his ordeal to the 2nd Complainant that he had also been defiled through his anus by the Accused person.
A report was subsequently made at the police station and the victims were issued with Police medical forms to be examined and treated.
Under the Criminal Offences Act of Ghana, this criminal offence is punishable upon conviction to a term of imprisonment of not less than seven years and not more than twenty-five years.
